Rape of a Child
This is defined as an act of sexual penetration with a child under 13 years of age. This includes any type of sexual penetration whether the act is performed on the child or on the adult by the child. It is a class A felony, punishable by a sentence of 25 to 60 calendar years in prison. Persons convicted of this offense are not eligible for probation or parole. They must serve their entire sentences.
Aggravated Sexual Battery
This is defined as sexual contact with a child under 13 years of age. It includes a touching of the breasts, buttocks or genitals of a child under 13 years of age. It also includes any sexual touching of the adult by the child if such touching is directed by the adult. It is a class B felony punishable by a sentence of eight to 30 years in prison. Persons convicted of this offense are not eligible for probation. They must serve a minimum of 85 percent of their sentence.
Rape
This is defined as an act of sexual penetration of another person either by force or without that person’s consent. It is a class B felony punishable by a sentence of eight to 30 years. Persons convicted of this offense are eligible for probation. But prosecutors rarely agree to probation and judges rarely grant probation. Persons sentenced to prison, must serve a minimum of 85 percent of their sentence.
Sexual Battery by an Authority Figure
This is defined as sexual contact with a child between 13 and 18 years of age by a person who has supervisory or disciplinary authority over the child. It includes a touching of the breasts, buttocks or genitals of the child. It also includes any sexual touching of the adult by the child if such touching is directed by the adult. It is a class C felony punishable by a sentence of three to 15 years. Persons convicted of this offense are eligible for probation. Persons convicted of this offense are required to register as sexual offenders for the rest of their lives.
Statutory Rape by an Authority Figure
This is defined as sexual penetration of a child between 13 and 18 years of age by a person who has supervisory or disciplinary authority over the child. This includes any type of sexual penetration whether the act is performed on the child or on the adult by the child. This is a class C felony punishable by a sentence of three to 15 years. Persons convicted of this offense are not eligible for probation. Persons convicted of this offense are required to register as sexual offenders for the rest of their lives.
Sexual Battery
This is defined as sexual touching of an adult either by force or without that person’s consent. It includes touching of the breasts, buttocks or genitals of the victim. This is a class E felony punishable by a sentence of one to six years. Persons convicted of this offense are eligible for probation. Persons convicted of this offense are required to register as sexual offenders for a minimum of 10 years after the expiration of their sentence.
